REPRESENTATIVE ACTIONS

Representative actions are actions or suits instituted, commencedย  and or conducted by one or more plaintiffs or defendants for on behalf of other party to the suit.

โ€“ Requirements for suing in a representative capacity.[1]

For an action to lie in a representative capacity, the following conditions or ingredients must exist:

(a) There must be a common interest;

(b) There must be a common grievance and;

(c) The relief claimed must be beneficial to all.

Reference should be made to the relevant Rules of court.
