Here are some key highlights of the conference;

This year’s conference will evaluate and discuss the use of arbitration and other Alternative Dispute Resolution (ADR) mechanisms, focusing on how these tools have significantly enhanced the ease of doing business globally, contributed to economic growth, and how similar developments can strategically position Nigeria and Africa at the forefront of international arbitration.

Key topics will include the management of investor disputes by African governments, with a particular emphasis on improving contract drafting and promoting local content in both domestic and international arbitration. The 2023 Protocol on Investment, established under the African Continental Free Trade Area (AfCFTA), represents a pivotal shift in investor-state dispute dynamics, creating new opportunities for dispute resolution in intra-African trade.

We will also explore the growing influence of technology, internet penetration, and Artificial Intelligence (AI) in reshaping business disputes and arbitration practices across the continent. In addition, the Business and Human Rights Agenda highlights ADR’s crucial role in resolving disputes related to corporate responsibility, governance, and sustainability. The conference will delve into how these issues intersect with Investor-State Dispute Settlement (ISDS) mechanisms.

Furthermore, with recent legislative reforms across Africa, including Nigeria’s Arbitration and Mediation Act (AMA) 2023, the region’s arbitration frameworks are becoming more dynamic. Innovations such as Third-Party Funding are emerging as transformative tools to improve access to justice, though their full impact remains to be seen.
